The Attorney-General plans to adopt NADRAC’s recommendation to propose amendments to the Legal Services Directions. The amendments will require agencies, unless and exemption is obtained, to develop and regularly review dispute management plans requiring appropriate use of ADR.
To assist agencies to comply with their new obligations under the Legal Services Directions, NADRAC has been requested, in consultation with the Office of Legal Services Coordination, to prepare a model dispute management plan. NADRAC is to report to the Attorney-General on this reference by 30 September 2010.
The Attorney-General has asked NADRAC to engage in consultations with relevant stakeholders on this reference. NADRAC is now seeking written submissions on the possible form and substance of a model Federal Dispute Management Plan and on the place for ADR in government agencies more generally. Responses to this inquiry are due by 19 March 2010.
