National Principles and Guide

NADRAC principles

On 29 April 2011 NADRAC presented the Attorney‑General with its final report on the Principles Reference. The report contains:

  • the National Principles for Resolving Disputes, and
  • a Dispute Resolution Guide.

NADRAC advocates the consistent application of the National Principles and promotes the supporting Guide as an important information tool to assist people in dispute in considering ADR as an alternative, or an addition, to litigation. The Guide contains a series of highly readable information sheets designed to assist the Australian public to choose their form of dispute resolution wisely. It complements the wealth of information packages already available for organisations and business.

NADRAC is excited about the prospect of reaching out to the Australian public with easily accessible information and advice to support people to achieve access to justice using ADR. Previous NADRAC reports have been intended for select audiences including legislators and practitioners. In preparing the Guide, NADRAC has worked to ensure that it has been written with the Australian public in mind as its intended audience.

NADRAC’s view is that one of the greatest strengths of the Guide is its ability to evolve through feedback from ADR stakeholders and the general community and be a living resource.

Background

To help raise awareness of ADR in the community, encourage national consistency in the use of ADR, and to better inform users of ADR about good practice, the Attorney-General requested NADRAC to prepare:

  • a statement of key national ADR principles, and
  • a supporting guide for users of ADR services.

NADRAC was initially asked to report on this reference by 31 March 2011. The Attorney-General gave NADRAC a short extension until 29 April 2011.

On 7 July 2010, NADRAC provided the Attorney-General with an interim report on this reference. The interim report is available on the National Principles for Resolution of Disputes page.
